In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor (as defined below) is not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes (as defined below). By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the independent judging organization, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes, in Sponsor’s sole discretion. Eligibility: The “New Girl™, New Year, New You!” Sweepstakes (“Sweepstakes”) is open to legal residents of the 50 United States, and the District of Columbia, who are physically located and residing therein, age 18 or older at the time of entry. Void outside the US, in Puerto Rico, and wherever else prohibited by law. Employees, shareholders, officers, directors and agents of TI Media Solutions Inc. (the "Sponsor"), FOX Broadcasting Company (“Fox”), Twentieth Century Fox Film Corporation and their subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. Sweepstakes is subject to all applicable federal, state and local laws and regulations.

Entry: There are 2 ways to enter.

Method #1: Visit www.ew.com/newgirlsweeps and follow all entry instructions to complete and submit the online entry form. Online entries must be received between 12:01 AM Eastern Time ("ET") on Wednesday, December 12, 2012, and 11:59 PM ET on Tuesday, January 8, 2013 (the "Sweepstakes Entry Period"). Online entrants are subject to all notices posted online including but not limited to the Sponsor’s and Fox’s Privacy Policy. Limit: One (1) online entry per email address per day. In the event of a dispute, online entries will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry.

Method #2: Mail a postcard, including your name and complete address, to: The “New Girl™, New Year, New You” Sweepstakes c/o The US Sweepstakes & Fulfillment Co., 625 Panorama Trail, Suite 2100, Rochester, NY 14625. Each postcard must be mailed separately and must be postmarked between Wednesday, December 12, 2012 and Tuesday, January 8, 2013 and received by Tuesday, January 15, 2013. You may enter as many times as you wish by mail. Photocopied, illegible, or mechanically reproduced entries are not eligible. All entries become the property of the Sponsor and will not be returned or acknowledged. Sponsor is not responsible for lost, late, damaged, misdirected or postage-due mailed entries.

Prizes/Approximate Retail Value (“ARV”)/Odds:

Grand Prize: Two (2) Grand Prize winners will receive one (1) $1,000 American Express® gift card (ARV: $1,000 each).

First Prize: Two (2) First prize winners will each receive one (1) $500 American Express® gift card (ARV: $500 each).

The Total Approximate Retail Value (“ARV”) of all prizes is: $3,000.00

Estimated odds of winning will depend upon the total number of eligible entries received but is estimated at 1:10,000.

The American Express® Gift Card may be used at U.S. merchants that accept American Express® Cards. No ATM cash withdrawal. Some limitations apply, including restriction on use of the Gift Card at cruise lines or for recurring billing. See Cardholder Agreement for complete details. Card cannot be redeemed for cash, except where required by law. This Card has been issued pursuant to a reward, loyalty or promotional program. This Card is issued by American Express® Prepaid Card Management Corporation.

Random Drawing: The winners will be selected in a random drawing on or about Tuesday, January 22, 2013 from among all eligible entries received. They will take place at the offices of US Sweepstakes & Fulfillment Company, an independent agent of the Sponsor whose decisions are final.

Grand Prize winners will be notified by email and will be required to sign and return, within ten (10) days of winner notification, an Affidavit of Eligibility, a Liability Waiver, and where allowable by law, a Publicity Release (collectively, "the Releases"). Prize package will be awarded within approximately forty-five (45) days after the winner is verified. The failure to respond timely to the notification may result in forfeiture of the prize and the Sponsor or Sponsor’s agent will randomly select an alternate winner from the remaining eligible entries. Failure to return the Releases within the specified time period may result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries for that prize. A prize will not be awarded/fulfilled until all such properly executed documents are returned.

First Prize winners will be will be notified by email and will be requested to confirm their name and address via a return email. The prizes will be awarded within approximately 45 days after the winner is verified.

If a prize notification or prize is returned as undeliverable, it will result in disqualification, and the prize will be awarded to an alternate winner in a separate random drawing. If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, his/her prize will be awarded in the name of his/her parent or legal guardian who must execute the Releases on the minor winner’s behalf. Prize is non-assignable or transferable to another individual, except to a surviving spouse.

Prize Conditions: Complete specifics and restrictions of prize will be furnished at the time or prize award. All prize details are at the Sponsor’s and Fox’s sole discretion. Prize is not redeemable for cash. Prize is non-assignable or transferable. At Sponsor’s and Fox’s sole discretion, a substitute prize of equal or greater retail value will be awarded. Other restrictions may apply. Any other incidental expenses on prize not specified herein are the sole responsibility of each winner. Except where prohibited by law, entry and acceptance of prize constitute permission to use each winner's name, prize won, hometown, likeness for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

The winners are solely responsible for all federal, state and local taxes and other costs and expenses associated with the receipt or use of the prize, if applicable.

Winners acknowledge that the Sponsor, Fox and all other businesses affiliated with this Sweepstakes and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize being offered. Prize is guaranteed to be awarded.

Release: Participating entrants agree to these Official Rules and the decisions of The US Sweepstakes & Fulfillment Company and the Sponsor and Fox, and release the Sponsor, Fox, Twentieth Century Fox Film Corporation and each of their parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors, representatives and agents of each; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the “Released Entities”), from all claims and liability relating to their participation in the promotion, and the acceptance and use/misuse of the prize offered. Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.

Indemnity: Winners shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with:(a) winners participation in the Sweepstakes; (b) a breach or allegation which if true would constitute a breach, of any of winner’s representations, warranties or obligations herein; and (c) acceptance, possession, grant, or use of any prize, including without limitation, personal injury, death and property damage arising therefrom.

Disputes/Arbitration: This Sweepstakes is governed by the laws of the United States and the State of California, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased. By participating in this Sweepstakes, each entrant agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Released Entities relating to, arising out of or connected in any way with (i) the Sweepstakes, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum. The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed upon by the participant and Released Entity. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Sweepstakes. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award special or punitive damages against the participant or the Released Entity. If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.
