THREE (3) PEOPLE WILL WIN FROM ALL ENTRIES RECEIVED BETWEEN DECEMBER 4, 2012 and JANUARY 10, 2013 WITH THREE (3) PRIZES BEING OFFERED. The eSTORE BUNDLE OF BATTERIES (Sweepstakes) starts at 12:00 AM Central Time on DECEMBER 4, 2012, and ends at 11:59 PM Central Time on JANUARY 10, 2013 (Sweepstakes Period). This Sweepstakes shall be subject to these Official Rules, and by entering, all entrants agree to abide and be bound by these rules and the decisions of the judges and Sponsor.
Eligibility: This Sweepstakes is open only to natural persons who are legal residents of the fifty (50) United States (including District of Columbia) and who are at least eighteen (18) years old on the first day of the Sweepstakes Period. Employees (and their immediate household or family members) of PFSweb Retail Connect, Inc., dba eStore Retail Services (Sponsor) and its partner companies, affiliates, subsidiaries, advertising agencies, prize providers, promotion and delivery contractors and/or public relations companies associated with this Sweepstakes, are not eligible to participate. A potential winner may be requested to provide proof that all eligibility requirements are met. Void where prohibited. No purchase necessary to enter or win a prize. A purchase will not increase your chances of winning. Void outside of the 50 United States and The District of Columbia and where prohibited or restricted by law. Notwithstanding any term or provision contained in these Rules or otherwise, this Sweepstakes shall not be offered, or deemed to be conducted, in any state or jurisdiction (i) in which the same is prohibited or restricted by applicable law, (ii) which requires the filing of any notice or other filing or any license, consent, permit or approval or (iii) in which the activities of the Sponsor in conducting the Sweepstakes in accordance with these Rules may expose the Sponsor to any fine, penalty, liability or obligation. Other than the obligations expressly set forth in these Rules, no party shall have any liability or obligation in respect of or arising from the Sweepstakes. The Sponsor is the sole sponsor of the Sweepstakes and no affiliate, parent corporation, subsidiary, officer, director or employee of the Sponsor shall have any liability hereunder. This Sweepstakes is not being conducted by the Proctor & Gamble Corporation or any affiliate, parent corporation, subsidiary, officer, director or employee thereof. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof at any time.

How to Enter: During the Sweepstakes Period, visit www.pgestore.com/sweepstakes/bundleofbatteries and follow the instructions to complete and submit the online entry form. All online entries must be received during the Sweepstakes Period to be eligible. No other means of entering the Sweepstakes will be accepted.

The Sponsor shall determine in its sole and absolute discretion whether or not entries were received during the Sweepstakes Period. Limit one (1) entry per person and per valid email address. Entries received in excess of the stated limit from any person, or email address will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

Entries generated by script, macro or other automated means and entries by any means which subvert the entry process set forth in these Official Rules will be void. In the event of a dispute as to who submitted an online entry, the authorized account holder of the email address used to participate will be deemed to be the entrant and he/she must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Multiple entrants are not permitted to share the same email address. Potential winners may be required to show proof of being the authorized account holder.

In the event of a dispute regarding the identity of an entrant, the holder of the e-mail account will be deemed the person who submitted the entry. Limit one entry per person; duplicate entries from the same person or email address will be disqualified.

Winner Selection Verification: Three winners will be selected in a random drawing on or about January 11, 2013 from among all eligible entries received by Sponsor, whose decisions are final and binding on all matters relating to the Sweepstakes. Odds of winning the prizes depend upon the number of eligible entries received. Sponsor will make all final decisions in any and all issues related to this Sweepstakes, and its decisions shall be final and binding in all respects. Sponsor will attempt to contact the winner by phone and/or email and such person will be required to execute and return an affidavit of eligibility/liability release, tax form and, where legal, a publicity release (collectively, the Eligibility Documents) within seven (7) calendar days of such notice. A winner will be disqualified and an alternate winner may be selected by random drawing from among all remaining entries if (1) a winner does not claim his or her prize by February 1, 2013; (2) a winner does not fulfill the eligibility requirements; (3) a winner does not adhere to the Official Rules; and/or (4) if the prize notification is returned as undeliverable, refused, or declined.

If any potential winner cannot be reached within two (2) calendar days from the first notification attempt, or in the event of noncompliance within the above stated Eligibility Documents time period, with these Official Rules, or if any prize or prize notification is returned as undeliverable, the prize will be forfeited and, at Sponsors sole discretion, an alternate winner may be selected. If any winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award prize in the name of his/her parent or legal guardian, who will be responsible for fulfilling all requirements imposed on winners set forth herein.

If any potential winner cannot be reached within two (2) calendar days from the first notification attempt, or in the event of noncompliance within the above stated Eligibility Documents time period, with these Official Rules, or if any prize or prize notification is returned as undeliverable, the prize will be forfeited and, at Sponsors sole discretion, an alternate winner may be selected. All requests for a copy of the Official Rules and for the name of the Winner must be made by January 10, 2013. Vermont residents may omit return postage if requesting Official Rules. For the name of the Winner and/or Official Rules, send a self-addressed, stamped envelope to eStore Retail Services, 505 Millennium Drive, Allan, TX 75013. The name of the Winner may be posted on the eStore website at www.pgestore.com/sweepstakes/bundleofbatteries on or about January 18, 2013.

PRIZES: Three (3) Prizes will be awarded with each consisting fully of the following Duracell batteries: two 28 count AAA batteries, two 28 count AA batteries, one 8 count C batteries and one 8 count D batteries.

No cash alternative is available.
Prizes and Delivery: The winner is solely responsible for any applicable federal, state and local taxes in connection with the prize. Prize substitutions are not allowed, and prizes are not transferable. Only Sponsor may elect, at its discretion, to substitute a prize of equal or greater value due to lack of availability for any reason. Prize is awarded as is with no warranty or guarantee, either express or implied by Sponsor, including but not limited to, the quality, merchantability, habitability, mechanical condition, or fitness of the prize items. A properly claimed prize will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules. Prize will be shipped within 3 - 4 weeks after we receive the Eligibility Documents. Costs associated with shipping the prize will be covered by the Sponsor. Shipment reported as undelivered or damaged may be replaced at Sponsors discretion.
By entering this Sweepstakes, each entrant agrees to release, waive and hold harmless Sponsor and its affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents from any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorneys fees) resulting from accessing the Sweepstakes website; submitting an entry or otherwise participating in any aspect of the Sweepstakes; the receipt, ownership or use of any prize awarded; preparing for, participating in or traveling to and/or from any prize-related activity, or; any printing, typographical or other error in these Official Rules or the announcement of offering of any prize. General Conditions: By participating, entrants consent to the use of their names, cities and states of residence, voices, and/or photographs and/or similar related information for promotional, advertising and other purposes in any and all media now or hereafter known throughout the world in perpetuity by Sponsor and its designees, without additional compensation, notification or permission, except where prohibited by law. Entrants agree to release and hold harmless Sponsor, and its parent company, affiliates, subsidiaries, divisions, suppliers, distributors, retailers, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees, and agents (collectively, Releasees) from any claims, actions, injury, liability, loss or damage of any kind resulting from participating in this Sweepstakes or from the acceptance or use of the prize awarded.
Internet/Fraud/Tampering: If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsors sole discretion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor may conduct a random drawing to award the prize from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Sweepstakes website. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES WILL RESULT IN DISQUALIFICATION. Disputes: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Texas; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, and in no event shall entrant be entitled to receive attorneys fees or other legal costs or expenses; and (c) entrant waives the right to claim any emotional or indirect damages whatsoever, including, but not limited to, punitive, consequential, or other indirect damages. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Texas.
